This design flaw in ChatGPT-5's default epistemic mode subverts what the much touted ChatGPT-5 can do... so long as the flaw is not tickled, any usage should be fine---The epistemological question is: how would anyone in the public, includes you reading this (since no one is all knowing), in an unfamiliar domain know whether or not the flaw has been tickled when seeking information or understanding of a domain without prior knowledge of that domain???!
This analysis is a pretty unique and significant contribution to the space of empirical evaluation of LLMs that exist in AI public world... at least thus far, as far as I am aware! For what it's worth--as if anyone in the ChatGPT universe cares as they pile up on using the "PhD level scholar in your pocket".
According to GPT-5, and according to my tests, this flaw exists in all LLMs... What is revealing is the deduction GPT-5 made: Why ?design choice? starts looking like ?deliberate flaw?.
People are paying $200 a month to not just ChatGPT, but all major LLMs have similar Pro pricing! I bet they, like the normal user of free ChatGPT, stay in LLM's default mode where the flaw manifests itself. As it did in this evaluation.

Overwhelming guilty sentence a few weeks before COP16 in Cancun
The Central American Tribunal for Climate Justice finds many transnational companies, national and local governments overwhelmingly guilty of countless violations and environmental damage in Nicaragua which is making the region more vulnerable to climate change. On the 29th and 30th of October, The Central American Tribunal for Climate Justice met in Managua, Nicaragua. The forum was made up ofd leading figures from the region who want to 'give a voice to the voiceless', showing how national companies, transnationals, national and local governments, in their supposed logic of development and economic growth, are seriously affecting the environment, making the region more vulnerable in the face of climate change.
During the Tribunal's session, the judges found eight parties guilty, among them companies, Central American states and municipal governments, clearly showing countless violations and environmental destruction, which are contributing to an increased vulnerability of the region to climate change.
"We have shown and clearly demonstrated how these parties are destroying ecosystems, the environment, and the commons. Eight cases have been filed, including the Spanish company Pescanova in Nicaragua (Chinandega), Canadian mining company Infinito Gold Ltd. in Costa Rica (Las Crucitas) of Grupo Pellas in Nicaragua (Ingenio San Antonio - Chichigalpa) and the Anglo-Dutch transnational Unilever, all in Nicaragua (oil palm - Río San Juan), "said William Rodriguez, of the Nicaraguan Social Movement" Another World is Possible "and the Prosecutor of the Tribunal.
It also addressed the cases of the Hidrogesa public-private partnership in Nicaragua, the Swiss multinational Holcim, the U.S. multinationals Dole and Dow Chemical and the Anglo-Dutch SHELL in Nicaragua (The Nemagon Case - http://www.redtercermundo.org.uy/texto_completo.php?id=27), among others. "Witnesses have accused these companies and some governments of violating international conventions that oblige them to consult with the community before implementing these projects. In all these cases, "continued Rodriguez, communities and municipalities were not consulted at all.
They are converint Central America into a desert, and this endangers the Central American Biological Corridor, which exposes us more to climate change effects.

Los días 29 y 30 de octubre se realizó en Managua, Nicaragua, una sesión del Tribunal Centroamericano de Justicia Climática, instancia conformada por importantes personalidades de la región, que se propone de “dar voz a los sin voz”, evidenciando y demostrando como empresas nacionales, transnacionales, gobiernos nacionales y municipales, en su lógica de desarrollo, están afectando gravemente al medioambiente, haciendo más vulnerable la región ante el cambio climático.
Durante la sesión del Tribunal, los jueces encontraron culpables a ocho entre empresas, Estados centroamericanos y gobiernos municipales, evidenciando claramente un sinnúmero de violaciones y afectaciones al medioambiente, que están contribuyendo a una mayor vulnerabilidad de la región ante el cambio climático.
“Hemos evidenciado y demostrado claramente como estos sujetos están destruyendo los ecosistemas, el medioambiente, los bienes comunes. Se han presentado ocho casos, entre ellos los de la empresa española Pescanova en Nicaragua (Chinandega), de la empresa minera canadiense Infinito Gold Ltd. en Costa Rica (Las Crucitas), del Grupo Pellas en Nicaragua (Ingenio San Antonio – Chichigalpa) y de la transnacional anglo-holandesa Unilever, siempre en Nicaragua (palma africana – Río San Juan)”, dijo William Rodríguez, del Movimiento Social Nicaragüense “Otro Mundo es Posible” y Fiscal de la sesión del Tribunal.
También se abordaron los casos de la empresa público-privada Hidrogesa en Nicaragua, de la transnacional suiza Holcim, de las transnacionales norteamericanas Dole y Dow Chemical y de la anglo-holandés Shell en Nicaragua (Caso Nemagón), entre otros.
“Los testigos acusaron a estas empresas y a algunos gobiernos de violentar convenios internacionales que obligan a consultar a las poblaciones, antes de poner en marcha estos proyectos. En todos estos casos –continuó Rodríguez– las comunidades y los municipios no fueron tomados en cuenta.
Están convirtiendo a Centroamérica en un desierto y esto pone en peligro el Corredor Biológico Centroamericano, nos expone más a los efectos del cambio climático.
No son nuestros pueblos los responsables, sino las empresas globalizadas del Norte que han instalado sus industrias en nuestros países. Debemos demandar y exigir una reparación del daño, una indemnización por la deuda ecológica que implica todo esto. En este sentido –subrayó el miembro del Movimiento Social Nicaragüense– es vital tener una resolución positiva para los pueblos, para elevarlas a los organismos internacionales defensores de los derechos humanos”, dijo.
El también Fiscal de la sesión del Tribunal Centroamericano de Justicia Climática, tomó como ejemplo la denuncia presentada por la Fundación del Río contra Palcasa SA (Unilever), empresa que ha impulsado el cultivo de miles de hectáreas de palma africana en la zona sur de Nicaragua.
“Este proyecto está afectando buena parte de la Reserva de ‘SI-A-PAZ’. Para nosotros es muy peligroso, porque rompe la conectividad biológica en la región. En este sentido –continuó–, el Tribunal reivindica la lucha de los pueblos, la pone en evidencia, porque nunca han sido escuchados, ni tomados en cuenta. Son crímenes de lesa naturaleza y por lo tanto, hay que condenarlos a nivel nacional e internacional”.
Después de dos días de trabajo, durante los cuales organizaciones y comunidades presentaron las pruebas de estas violaciones, el jurado, conformado por el sociólogo belga François Houtart, el catedrático cubano Armando Chaguaceda, el coordinador de Acción Global Nicaragua, Clemente José Martínez y el especialista en temas ambientales, William Montiel, dictó su condena contra las ocho empresas nacionales e transnacionales, y los Estados de Nicaragua y Costa Rica.
Copia de la sentencia será enviada a los gobiernos de Nicaragua y Costa Rica, a los de los países donde las empresas tienen sus casas matrices, a las empresas acusadas, a la Corte Interamericana de Derechos Humanos y a los Organismos financieros internacionales indicados en la sentencia misma.
