When the state, the agencies of the state and the re-zoners(pardon me, Council) are going to put a road through it. Thus 4,000 people objected to the An Bord Pleanala decision to Route the M3 through the tara Gabhra Valley. One person goes to court to seek judicial review of that decision, (gets hammered for 600,000 grand) and the message we take from this is, do not attempt to engage with a system and structure of planning that is designed to disempower your community or your legitimate right to protest. I quote from the affidavitt: "None of the 38sites/monuments are considered to have a group value or to have any relationships with the other monuments. At the risk of sounding frivolous, does this mean that they and their occupants or creators dropped out of the sky and did not interact with any other living soul or place in this landscape?" This ,from the state is what the 600,000 grand paid for. We are looking at appeal . read full story / add a comment

* Update on campaign to save the Hill of tara from the M3 motorway – 12 March 2006 A discrete national monument has been discovered in the pathway of the M3 motorway, during investigative archaeological excavations. It is entitled Baronstown 1, by the NRA, and lies just on the other side of the N3, between the hills of tara and Skryne. It can be seen at: http://www.m3motorway.ie/Archaeology/Section2/Baronstown1/ A protest involving local and national activist groups is planned for 12.00PM, March 15th, at 'Baronstown 1', a newly discovered national monument in the pathway of the M3 motorway. Evidence regarding this site was not allowed to be presented in the High Court case, because Justice Smyth denied an application for cross-examination of expert witnesses. read full story / add a comment

The case against the state challenging the constitutionality of the amended National monuments act 1930-2004 has been deffered for the third time. The date for judgement of this important case had been variously given, the last one was Feb 16th, the day of the launch of the Planning and Development Bill 2006,(The Strategic Infrastructure Bill)I am not a lawyer, and have not studied the details of the Carrickmines case too closely, but the locus of the case was based on the signing of the joint consent order to destroy the castle remains at Carrickmines and to remove sections of the revetted fosse. Ministerial consents for destruction of a national monument could occur after 21 days sitting of the Oireachtas, which in real terms gave the minister his unreviewable discretionary powers. The judgement was listed for tomorrow but is now deffered, it will have a direct repurcussion on the situation at the tara Complex and other heritage sites in Ireland. No reason has been given for the deferral. The case has been put back for mention for Thursday the 9th of March. read full story / add a comment

The challenge currently under way in the High Court to the lunatic M3 motorway has brought out an important fact that the corporate media have, as is their wont with important facts, ignored: that the present administration has done more to undermine heritage protection than any in the Republic's history. read full story / add a comment
