Okay this is pretty basic - A referendum is needed every time a government wishes to change our constitution - this is because the constitution theoretically exists to protect people from the excesses of any government i.e. any elected government can only work within the confines of what the constitution sets out. This means the constitution belongs to the citizens (i.e. us) not the Government. Whatever government is in power has to get our permission to change it. Lots of things in our constitution are outdated and need to be changed BUT and it's a big BUT we should be really careful of letting it be changed for trivial issues.

Two successive days of entertaining radio as the motley crew opposing Martin McGuinness (Michael McDowell, Fintan O'Toole, Ed Moloney, Gregory Campbell, etc) get their act together. Fintan and Ed have difficulty debating. On Tuesday (Sept 20) on the Pat Kenny Show, Ed Maloney refused to appear with Danny Morrison. That was after imposing the same conditions on the BBC. A very important fellow is Ed, who likes to be able to chose who is good enough to appear alongside his elevated self. An even more important person is Fintan O'Toole, who, after a long innings on Radio Ulster's Stephen Nolan Show (September 21), took up his ball and ran. European politics are no doubt scintilating for the average Irish citizen now Lisbon2 is behind us & our continuing place at the heart of Europe is assured. We expect the Dáil expense scandal which hints at as much outragous sociopathic graft & cheek as our rivals in the British parliament will keep us in the top rankings. We can read about Berlusconi unknowingly frolicking with prostitutes and cocaine traffickers and think it slightly pathetic that he imagined his pretty guests were up & gaggin for it. Now new scandal at the heart of Europe which alas, is in the process of being hijacked by the far right! Sarkozy's minister of Culture, Frédéric Mitterrand, who though son of the socialist president chose a rightwing career path, is at the heart of the EU. In the lead-up to a new set of agreements between France and Thailand to stem sex tourism, passages from the minister's 2005 biography describing the thrill of sex with young Thai boys are raising interest of both prurient and legitimate nature. read full story / add a comment

Since Michael McDowell changed the law to impose strict penalties on members of the Garda Siochána who talk to journalists, there has not been any legal way for members to report malpractice, except through using internal channels. Experience has shown that the gardaí can be extremely unsupportive of those who seek to draw attention to failings of their colleagues. While some people have expressed disbelief at whether a political appointee can be be truly trusted to be independent of political influence, those who can remember the evidence heard in a case in the High Court in 2006 have wondered whether the particular person chosen will be able to inspire confidence in the rank and file gardaí. read full story / add a comment

This is a short opinion and analysis based in an article written in December 2006 regarding the Press laws introduced by the then Minister for Justice, Michael mc dowell. Michael mc dowell, being back in the High Court defending the Rights of the Father is awaiting judgement of the Mr 'G' case, in which a father has applied for return of his kids from another jurisdiction (UK) and the right to be a father and to educate his children. Another recent High Court case is being prepared to go to the Supreme Court regarding the rights of a woman to use the eggs she is storing and to have the dad pay for the future life and education of any child conceived as result of the process- the father won citing the end of the marriage and irreconcilable difference. She is appealing. Both cases involve:- Father's Rights to family and both are read for and judged within the confines of the Catholic Constitution drafted by De Valera and of course substanially amended by Archbishop mc Quaid. Last week we all watched as the titular head of the Irish justice Department actively deported a six year old autistic boy, along with his twin sister and his mother. They were put on a commercial flight to Lagos, late at night and given enough cash for an hotel. In the last day a Mexican woman who had sought refuge for 12 months in a church and had become the voice of economic migrants and illegals in the US was picked up and deported to Tijuana, leaving behind her, her eight year old boy Saul. Elvira Arellano has vowed to continue her fight from the other side of the border. If we look at the newswire the overwhelming amount of these cases have involved women and children. 3 years ago the state of Ethiopia began what would become a monumental struggle when they announced their intention to trademark their Coffee Bean. The Ethiopian highlands & the surrounding "horn of Africa" were the origin of the drink coffee as far back as the 9th century [common era]. Specifically the Ethiopian state wanted to assert internationally recognised intellectual copyright on a range of coffee beans which to this day are mostly cultivated in the east African state. Many welcomed the move as evidence that late 20th century capitalism which has seen ownership concepts extended to ideas, living organisms & even specific genecodes could be a game which the poorest states might play to their advantage as well. Then came the orchestrated response of the Seattle USA based multi-national corporation Starbucks. Earlier this month both the company and state came to a settlement. read full story / add a comment

We do not know if the new improved EC Constitution which will be voted in 2008 includes a 'God Clause' but we do know that the good German Doctor Kues has plans for the women of the EU, which is to promote the equality agenda through rediscovering the traditional family. To Precede this 'Opinon and Analysis' on the Constitutional crisis of May and June 2006 and right up to this election, I want to state that the statute which came about as a result of emergency legislation equally mitigates against the 12-17 year old pre-consent boy; but the sub-title of the piece is focussed on the creation of an under-class. The collapse of the 1935 legislation which came about as a direct result of the Laffoy Judgement on the 'A' case led to the introduction of the Criminal Law (Sexual Offences) Bill 2006, (amended 2007), this included the insertion of the unconstitutional section 5 into the statute, which still stands , without repeal and without re-visit. read full story / add a comment

The best speech in the house of eunuchs, otherwise known as the Dail was that given by Joe Higgins who alluded to the Poodles pissing against the lamp-posts in Dublin 6W upon which Minister mc dowell was hanging his posters.
