Two leading anti-bin charge activists have case struck out by Judge.

Drogheda Residents Against Bin Charges And Privatisation (DRABCAP) activists Bernard Gallagher & Harry Phelan had an alleged littering offence struck out at the District Court on Friday 10th last by Justice Flann Brennan. Drogheda Borough Council sought to adjourn the alleged offence case against both DRABCAP activists for a second time when both men objected to the Judge, they pointed out that they wished for the case to proceed as the litter warden was present. Following arguments put forward by both Mr. Gallagher & Mr. Phelan the Judge struck the case out against both DRABCAP activists, Harry Phelan stated in Court to the Judge that it was ‘ a miss-application of the Law by Tallan & Co.’(acting on behalf of the Borough Council), for filing a case when they knew that all their witnesses where not going to be present.

Following the case DRABCAP activist Harry Phelan stated ‘It’s obvious that the Borough Council and their Legal Representatives had a different agenda other than the proposed alleged offence under The Litter Pollution Act 1997 but their case fell flat on their face, I must praise the honourable Judge Flann Brennan for taking all aspects of the case into account.’

Funny how so few people in Drogheda now have any interest in the anti-Bin charge group. It will of course go the same way in Fingal, when in a few months all that will be left is the real hard core loud mouths.

Fingal should also note that the Drogheda group were fatally damaged by the attempts of Sinn Fein to take over and in doing so try to get more legitimatcy in the town. It didn't work and led to a severe spilt in the camp and the inevitable demise of the lobby group. The only traces of the group are now in the Moneymore and Ballsgrove estates.

Yes Mojojojo, you are quite right that a Sinn Fein element was trying to control the Drogheda Campaign but that element has long been ousted namely Ken O'Heiligh and his messenger boys and the like as their agenda was self gratification only and not in anyway genuine or principled against (as we term) the 'Illegal Bin TAX. Those of us who are presently in the Cross Community Voluntary Organisation of Drogheda Residents Against Bin Charges And Privatisation (DRABCAP) have no party political agenda and can honestly say to you that our only goal is to expose the facts and figures of Drogheda Borough Council on this issue and many more, keep an eye out for our High Court Judicial Review on this matter very soon.

Mojojojo, there are genuine, honest, principled Citizens that don't have a political agenda of which we are only some.
