Sinn Féin denounce Supreme Court decision
Sinn Féin spokesperson on Justice and Equality Aengus Ó Snodaigh TD has expressed his "deep disappointment" at the ruling by the Supreme Court, which has cleared the way for the Government to deport non-Irish parents of Irish children. The Dublin South Central TD said the judgement made second-class citizens of some Irish children and would "encourage racism".
Deputy Ó Snodaigh said:
"This ruling by the Supreme Court is a deep disappointment to all of us who value the fundamental equal rights of all Irish children and indeed equality amongst citizens. Sinn Féin believes that all Irish children regardless of parentage are entitled to the care and company of their families. Rather than cherishing all the children of the nation equally the judgement in effect makes second-class citizens of some Irish children because of the ethnicity of their parents. I believe this will encourage racism in that it will give succour to those who feel that Irish children born to people of a different ethnic background are somehow less Irish.
"Sinn Féin believes that all Irish children are equal, regardless of parentage. We believe all Irish children are entitled to the care and company of their families as a right. The law must reflect this."

No mention of asylum seekers with Irish children, some of whom must be of school-going age by now. Just the usual implication that asylum seekers arrive here heavily pregnant in order to 'take advantage of us'.
Does this then mean that German people with Irish born kids will also be deported? If the Minister needs me, I have a few people I know who need deportation, they annoy me, take them away!

Horrendous ruling. I have a feeling that this will prove to be the first of a series of efforts to roll back legal and constitutional advances in the state.
The next being the removal of equality discrimination cases out of the hands of the equality authority investiagtion office to the district courts.
Lets hope that in a few years time that we don't fondly recall the days when Ireland was liberal!
Is this Government mad? Non-EU nationals do not get the right to live with their kids. So instead of a policy we now get a minister with discretion to judge each case on its 'merits', ah yes, discretion: the refuge of the bewildered.

According to someone on the radio this morning, a child still has the right to be with its parents but the parents do not have the inalienable right to stay in the country based on the right of the child to its parents. Is this correct?
If it is agreed that a child has the right to be with its parents (locus parentii or something) and it can be safely assumed that the country this applies to is Ireland ('cause we wouldn't be saying that a child has the right to be with its parents in Siberia) then I don't understand how they could remove the parents from the child to deport them (presuming they can't forcibly deport a legal Irish citizen - the child).
Anyone got this figured out?
